Homeland Season 2

What a start to the second season of Homeland, it
had everything, tension, another brilliance performance
by Danes, and a storyline that I really love seeing
developed, and that is the father/daughter relationship.
Her helping bury the copy of the Koran was a sweet
moment.

This is going to be pivotal to the decision  that Nicolas
Brody finally makes, will it be family that will rule over
his current  false belief that he has to kill the president/vice
president.

I think the wife character and the son are red herrings.

The whole terrorist thing is also a red herring, this is a family
versus warp religious beliefs story, in real life the Phelps
family has made the wrong choices, dismissing
family members who don't share their disgusting
views on gay people, and this is a fiction story about
one man's warp view of the Koran and whether
he will put his daughter's love first.

Well that's my take on it.

Time well tell.

The Presidential Debate: Baseball Quiz

The Huffington Post's Aaron Zelinsky, who has written extensively about the intersection of sports, law, and government (see his Yale Law Journal Online article The Justice as Commissioner: Benching the Judge-Umpire Analogy) has an interactive piece on the Huffington Post called "The Presidential Debate: Baseball Quiz".  Try to match the presidential debater with the ballplayer they most resemble.

Wilson Dixon New Zealand's worst standup Comedian

Wilson Dixon is not only the worst stand up
comedian New Zealand has produced, but
he must also be one of the weakest stand up
comedian's on the globe.

Can you imagine, if  someone wanted  to satirize a rock
star image, and they ended up dressing like Cliff Richard.

Can you imagine if someone wanted to satirize a pop
star and they dressed up as Jerry Lee Lewis.

Can you imagine if someone wanted to satirize a
Rap artist and they had a Basketball in their hand.

Well every Journalist, every critic, every member of the
public would boo that comedian off the stage.

For some reason though, this guy is cheered, are
kiwis this dumb? are we that ignorant of the genre
of country music, that we think this is good
satire, that we think he has perfected it?

He is not even close, to what  a good satire of
the country music genre would be.

He needs to take lessons from a Jeff Foxworthy
or a Rodney Carrington.

But hey, when you have Journalists and critics
such as the ones in New Zealand, you don't
have to be close, you don't have to be anywhere
near perfect, you just have to talk in a strange
accent about horses while wearing a hat.

His unfunny advice to wannabe country singers
to "have sex with an animal" is just pathetic and pointless,
can you imagine if a stand up comedian making fun of
the rap genre said his advice to wanna be rap singers
would be to  "Go out and attack a white woman'

There would be hell to pay.

My biggest problem with so called comedian Jesse
Dixon's alter ego, "Wilson", is that he isn't funny.

SLIPPER CHIC: NOT FOR PAJAMAS ONLY

If we did not love Celine enough already, now Phoebe Philo has really gone and done it showing these fuzzy slides and pumps for spring 2013. Can't you just feel the cozy softness now?  If only those pumps were available for those cold NYC nights to come. Our feet would be so happy!

But we have a whole winter to get through first and luckily have been given license to wear fuzzy slippers for the next few months in preparation for these spring shoes. So if slippers are the new "it" shoe,  here are nine I think make the the fashion statement that its all about comfort now.

1. ACORN: TEXTURED MOC  2. EMU AUSTRALIA: TOVA 3. UGG: ANSLEY 4. MINNETONKA: CALLY SLIPPER 5. PATRICIA GREEN: BONNIE  6. GIESSWEIN: GEROLDING  7. ACORN: SPA SLIDE  8. SMART DOGS: KENYA

Lance Armstrong and Morals Clauses

I was asked an interesting question recently, in the aftermath of Lance Armstrong's decision to no longer contest the doping allegations pending against him.  Would his failure to contest the allegations trigger a morals clause in any of his endorsement contracts and lead present or former endorsing companies to sue him?

It's an interesting question on a number of levels.

First, assuming his endorsement contracts do have morals clauses, the critical issue is what specific language they provide.  Do they have broad enough language to cover a situation where the conduct at issue hasn't been admitted, but is no longer being contested?

If the morals clause is broad enough to even be triggered, is it too late for the endorsing company to assert a claim?  The answer to this question depends on what the basis for the claim is and when the conduct at issue occurred.  For example, would the claim be for breach of contract, which has a statute of limitations of six years in many jurisdictions?  Would the claim be for fraud, based on Armstrong's misrepresenting at the time he signed a contract that he was not engaged in doping?  Fraud claims often have a shorter statute of limitations, typically three years.

The other fundamental questions is what the offending conduct is and when it occurred.  Armstrong won his first Tour de France in 1999 and his last in 2005.  If the basis for a breach of contract claim arises from doping during that period, it would appear that any claim would be barred based on the statute of limitations, unless a plaintiff could argue that the statute was tolled based on concealment of doping.

One final issue, regardless of the legal issues surrounding a claim based on a morals clause, is whether it is worth it for any company that endorsed Armstrong to bring a claim.  Would a company want to spend the time and money litigating to recover endorsement fees so long after the fact, and essentially having to prove that Armstrong doped?  Thus far, no company that endorsed him has taken such action.
